I HIRE GENERIC TYPE FOR RENDERING OF SERVICE

Contract of a plan of accommodation with Space WWW Services C.B.

The hiring of a plan of accommodation, the acceptance of this contract supposes under the cover of the RD 1906/1999 on telephone and telematic hiring, and it is understood signed by the CONTRACTOR on having hired the service of web accommodation.

The present REGULATIONS will result from application for the contract that there sign the CONTRACTOR and SPACE WWW SERVICES, C.B.:

The subscription to the services given by Space WWW Services, C.B. will be carried out by electronic means, with the cumplimentaci�n of the forms that Space WWW Services, C.B. puts at the disposal of the users, and that are available on line together with the software necessary for the access to the service.

The acceptance of the present REGULATIONS and the cumplimentaci�n of the form "Comprar_Datos_Usuario" and "Comprar_Resumen_Compra" there will imply the formalization of the contract between the CONTRACTOR and Space WWW Services, C.B., that will have vigor from such an acceptance.

For the present contract, the company Space WWW Services C.B. promises to give telematic services in the Internet network under the following conditions, for which Space WWW Services offers accommodations inside the space of his servants in the Network, being different the types or classes of accommodation that are offered.

Regulations:

1. OBLIGATIONS OF SPACE WWW SERVICES

The entity Space WWW Services C.B., it will provide to the CONTRACTOR, from the hiring, the following services referred to the domains:

1.1 Connection. The domains are lodged in servants under operating system Linux or Windows connected to the Internet Network of permanent form.
1.2 Primary and Secondary servants. Space WWW Services C.B., it will provide primary and secondary name servants for the CONTRACTOR, being she the manager of the works necessary for the appropriate execution of operations and accesses to the same ones at all times.
1.3 Safety copies. Space WWW Services C.B., he promises to realize safety copies or Backup, of the content of the servants or servant where the CONTRACTOR has guest his web page and all his content.

Nevertheless the previous thing, Space WWW Services C.B., he will not become responsible for the accidental loss of information than for any cause foreign to Space WWW Services C.B., do not take place, likewise, either it will be possible to guarantee that in the processes of information retrieval of the safety copies these could be restored correctly.

Therefore responsibility of the CONTRACTOR will be the maintenance and creation of its own copies of safety on the information that he publishes in his domain or employed accommodation.

1.4 Responsibility of Space WWW Services, C.B. Space WWW Services C.B. cannot guarantee that the availability of the domain will be continuous and uninterrupted during the period of validity of the contract, due to the possibility of problems in the Internet network, you damage in the teams servants or other possible unforeseeable risks.

Likewise, after the same machine shares the domain with other domains, attributable technical problems can take place to third, and of which Space WWW Services, C.B. does not take responsibility.

Therefore the contractor gives up claiming definitely any responsibility, contractual or extracontractual, dammages to Space WWW Services, C.B. for possible mistakes, slowness or errors in the access and use of the employed service.

Nevertheless the previous thing, if Space WWW Services C.B. was breaking the commitments assumed in this contract for giving an inefficient service during an uninterrupted period of 48 hours, the responsibility of Space WWW Services, C.B. will limit himself to the return of the money received for the domain during the period of ONE MONTH.

1.5 Technical support. Space WWW Services C.B., it will provide the CONTRACTOR from the date of hiring of the service, the whole necessary support and the opportune technical assistance for the development, enlargement and progress of his activities relative to the domains signed in the servants of Space WWW Services C.B.

The above mentioned Technical support will realize the CONTRACTOR by e-mail and will base principally on the center of support and Web community, databases system with frequent questions, technical manuals and references to third resources.

This way the CONTRACTOR, will request of Space WWW Services C.B. technical help, sending request or ticket of help from the Center of Support web route, having to refill the form presented by Space WWW Services C.B. The CONTRACTOR will be answered by the technical staff of Space WWW Services C.B., to the biggest possible briefness.

The attention of the technical service, it will be realized exclusively across the e-mail inside the Network, without being hired the telephone service, which remains definitely excluded from the present contract and which cost would be invoiced new paragraph as current tariffs.

Typical of the Technical Support. Space WWW Services C.B., by means of his personnel and corresponding technical staff, it will offer the CONTRACTOR who requests it in the terms foreseen in the previous paragraphs, technical assistance on the aspects referred to the service of accommodation. Without being able to offer this assistance to questions related to the programming of applications in general, I design of the same ones, dressmaking and configuration of databases, consultancy, marketing and development of the Web in general terms.

With regard to the assistance and information referred to the scripts that have been created or produced by Space WWW Services, the above mentioned technical assistance will be based in giving the opportune information about the installation. In any case there remains excepted the modification or changes on the scripts both on his pages and in his codes.

In any case, and for express request of the CONTRACTOR, Space WWW Services C.B., it will be able to transmit his commercial and technical references of those CONTRACTING or third companies that could give the previous services and that are out of the object of the present contract.

2. OBLIGATIONS CONTRACTOR.

2.1 Code of Conduct. The CONTRACTOR has definitely prohibited the use of the servants property of Space WWW Services C.B. for the following ends:

Ends that are against of the Spanish laws, norms of the European Union or any action that goes against the intimacy of the persons, or that should be opposed opposite to diverse reasons like the right to information, to the dignity and the morality he publishes.

The content of the files that are public across the World Wide Web, they perform exclusive responsibility of the CONTRACTOR. Remaining definitely liberated of any legal, penal, mercantile liability, or of any other nature, the entity Space WWW Services C.B.

The use of "Cracks" will remain definitely excluded from the object of the present contract, "Mp3s", without being in possession of the opportune rights of Author, "Warez", "serial numbers of programs" or any other content that damages the conditions of use and manipulation of the Intellectual property, imposed by proprietors or owners of the same ones.

Definitely prohibited in the present contract the use stays on the part of the CONTRACTOR, messages of racist, xenophobic, pornographic or erotic type.

There remains definitely prohibited the use of the Servant or Servants of the mail of the domain and of the e-mail addresses in him lodged, with the so called ends "spamming", or mailing of not wished massive e-mails (to see point 2.2). As well as also the use stays taxativamente prohibited of "mail bombing", or mailing of big messages in order to servants of the Network block.

2.2 Massive post office mailing. All the massive post office mailing must fulfill the following norms:

The CONTRACTOR must have the demonstrated assent of the recipients of his post office. The directions are not valid obtained automatically or illicit. All the directions must have been obtained with authorization of the recipient.
The CONTRACTOR must take a control of the valid directions of mailing, that is to say, he must verify that the directions to which he sends the post office are valid and recepcionan appropriately his messages. All the returned messages must be eliminated of the list of distribution.
The CONTRACTOR will have to include in the message a clear, preferably automatic form, so that the recipient of the same one could be dismissed of his list of mail.
The CONTRACTOR must try that the size of the mail is as small as possible. The images must be indexed by means of an URL to the web page of the CONTRACTOR, they must never be enclosed in the proper message. The maximum size of the message must never be major of 300K.
The content of the message must allude clearly to the domain from which the CONTRACTOR sends it. Post office mailing is not allowed in whose matter does to itself publicity or references to domains that are not the issuers of the message.
The direction of email that appears as issuer of the message must be indicated clearly and belong to the same domain from which the mailing is realized.

Any massive mailing of post office that does not fulfill these norms will be annulled and the pendent service temporarily.

Space WWW Services C.B., she remains authorized by means of the present contract to proceed to the automatic annulment of these accounts where there is observed the use of these types of actions or any others that should go against the good functioning of the Network and of his servants.

2.3 The use of the programs or applications of the servants of "Chat", who work under support CGI, SSI, they will be definitely out of the object of the present contract and therefore prohibited his use for the CONTRACTOR.

2.4 To watch the size of the transference of information of every domain in order to take the necessary actions if he thinks that his increase is excessive. For such an end, the CONTRACTOR arranges in the control panel daily updates, in which there appears the information about the consumption of every day and accumulated in the month.

In addition to the previous thing, the arranged will be observed in the point 5 of the present contract.

This way also the nonperformance of the present clause on the part of the CONTRACTOR, will give place to the resolution of the present contract on the part of Space WWW Services and the CONTRACTOR will not have right to claim any indemnification.

3. SYSTEM MAINTENANCE

Space WWW Services C.B., she remains authorized to carry courts out in the line hired to have the access to the Internet Network in all those cases that motivated by the need to carry out some adjustment, modification or progress as well as to the repairs of possible breakdowns, are directed to the progress of the service and his services, as well as to the reestablishment of the service.

4. TARIFFS AND CASHING.

4.1 Tariffs and plans. The tariffs of the plans are reflected of way detailed in:

The characteristics and prices of every service can change, being notified to all the CONTRACTORS with at least 10 days of advance.

The CONTRACTOR will have to pay the price stipulated in advance by means of the following forms of payment:

Transference or revenue in account.
Bank direct debiting.
Credit card.

The regularity of the contract will be established at the moment of the hiring of the service.

Any change or modification of the registered office, financial information, information of the account etc., will have to notify in writing route fax to +34 911 410 119 or by e-mail to espaciowww@hostinghousing.info for his rectification in our database, being accompanied of the signature and the copy of the ID card or identification of the contact person who appears in our records and who understands herself like signatory of this contract.

Any derivative anomaly of the information of the CONTRACTOR is not correct, will not be a responsibility of Space WWW Services C.B.

5. TRANSFERENCE OF INFORMATION.

The level of transference of information is limited initially according to the employed service, unless for operative needs of the servants it has to diminish for a certain CONTRACTOR.

5.1 Surcharge of a Servant. When Space WWW Services C.B., determine that the resources consumption in a domain is saturating or overloading the machine where this domain resides, the CONTRACTOR will be warned by means of e-mail to his contact account to communicate to him the state of his domain and the temporary suspension of his service until the CONTRACTOR should modify the level of consumption of resources up to an acceptable level determined by Space WWW Services C.B.

In case of discrepancy for not agreeing, the CONTRACTOR will be dismissed and there will be reimbursed to him the hanging quantities to finish the contract giving place to the resolution of the present contract on the part of Space WWW Services C.B., and the CONTRACTOR will not have right to claim any indemnification.

We understand for excessive resources consumption the processes of programs like CGIs, chats, demons, crons, databases, or any other program that completes excessive memory, hard disk or any process of the servants. Space WWW Services C.B., it will always determine when a domain is making an excessive use of the resources.

6. RETURNS AND NON-PAYMENTS

6.1 Returns. The returns of the charges carried out by Space WWW Services C.B., for the employed services and properly given, they will cause to the CONTRACTOR a Charge to the value of 12 Euros. By way of the return expenses.

6.2 Non-payment. Come the corresponding expirations, without the CONTRACTOR having carried the agreed payment out and passed seven (7) days from the same one, without the CONTRACTOR carrying the established payments out it will be possible to proceed to the suspension of his account.

6.3 Suspension. When 6.1 and 6.2 takes place for giving him the circumstance reviewed previously in the regulations one will proceed to the defusing of the connection of the CONTRACTOR to the Internet Network, both the access FTP and the Web. In case of problems met the cashing of the service, the account of the CONTRACTOR will be able to be blocked up to the resolution of the same ones.

Space WWW Services C.B., it will load in addition to the special return expenses previously, a quota for activation for 15 Euros.

He remembers on both parts that; passed ten (10) days from the expiration of any of the payments established in the present contract, without the CONTRACTOR having carried out the payment of the same ones, Space WWW Services C.B., it will be able to deactivate completely the access to the Network, as well as it will be able to proceed to the erasure of his account, remaining decisive the present contract, without Space WWW Services, he having to return some quantity for quotas or indemnify quantity for caused dammages.

7. LEGAL LIABILITY

7.1 The CONTRACTOR exonerates to Space WWW Services, C.B. of any responsibility related to the content of the information delivered for his storage in the assigned area of the servants of Space WWW Services, C.B.

7.2 The CONTRACTOR is the responsible only one opposite to any claim or legal, judicial or extrajudicial action initiated by third persons both against the CONTRACTOR and against Space WWW Services, C.B., and cradle on the content of the above mentioned information, assuming the CONTRACTOR all the expenses, costs and indemnifications are irrogadas to Space WWW Services, C.B. owing to such claims or legal actions.

8. CONFIDENTIALITY

8.1 The CONTRACTOR recognizes that, by virtue of his contractual relation with Space WWW Services, C.B., it might have access to information and materials related to the plans of business, technologies or strategies of marketing of big value for Space WWW Services, C.B.

8.2 The CONTRACTOR promises not to use this information in his own profit not in of third not authorized by Space WWW Services, C.B.

8.3 Space WWW Services, C.B, will be able to gain access to the accounts of mail created for the CONTRACTOR as well as to the safety copies and servants exclusively for the purpose of giving the in charge services and for maintenance tasks, promising not to use the above mentioned information with other ends and not to communicate them to third respecting at all times the professional secret. Space WWW Services, C.B. promises to implement the necessary technical and organizational measurements to guarantee the safety of the information.

9. PROTECTION POLITICS OF INFORMATION

Space WWW Services C.B., in observance of the Organic law 15/1.999 of December 13 of Protection of Information of Personal Character and complementary regulation, he informs the contractor of the following thing:

All the information of personal character obtained across this web page will be incorporated into the corresponding automated files. These files have been communicated to the protection Agency of Information and they are registered and his disposition for his consultation in the web https://www.agpd.es

By means of the communication of the information on the part of the CONTRACTOR, this one gives his assent to the automated treatment of his information of personal character.

The recipient and responsible for the files for information of personal character the entity is a Space WWW Services C.B.

The CONTRACTOR or natural person who represents him can exercise his rights of access to the personal information, rectification, cancellation or opposition recognized in the Organic Law 15/1.999 by means of the access to the above mentioned information across the mailing of a communication to the post-office box n� 88, 28250 Torrelodones, Madrid. This communication also will be able to be realized by means of the mailing of an e-mail to the direction espaciowww@hostinghousing.info

Space WWW Services C.B. also will be able to register the directions IP of the CONTRACTOR to diagnose any problem with our servant, to administer our web page and to analyze the tendencies of the users.

10. RELATIONS AND NOTIFICATIONS BETWEEN THE PARTS

10.1 The relations between the parts are those of a CONTRACTOR and a provider of services.

10.2 The CONTRACTOR will not have any right to force to Space WWW Services, C.B. before third without the express assent of Space WWW Services, C.B.

10.3 If the procedural legislation should demand the opposite, the parts agree to communicate by e-mail, fax or postal mail, using the directions and numbers more updated in his power. The parts will be forced to preserve proof of having realized the notifications to the opposite part.

11. DURATION OF THE CONTRACT

The present contract will be of application from the date of acceptance of the same one on the part of the contractor. The duration of the present contract will be the stipulated one for every service, according to figure on our web page http://www.hostinghousing.info/Servicios.php.

The present contract is understood renewed tacitly if the parts continue in the fulfillment of his subscription obligations.

Therefore, come, without any of the parts having denounced to other one the resolution of the same one, with a minimal advance of 30 days, the signed ones have left the ending of the present contract extended the present contract by tacit reconduction, by equal periods initially.

Nevertheless the previous thing, Space WWW Services, C.B. will be able to solve of immediate form the present contract in the assumption of nonperformance of the obligations of payment established for the CONTRACTOR by virtue of the present contract and according to the clause four of this contract.

Space WWW Services, C.B. will be able to exercise this right without need for any notice and the CONTRACTOR will not have right to claim any indemnification.

12. MODIFICATIONS FOR THE CONTRACT.

Space WWW Services, C.B. will be able at all times to do modifications in the terms of this contract if he communicates it to the CONTRACTOR with at least 30 days of advance.

It will be understood that the CONTRACTOR accepts if past this period keeps on using the services of Space WWW Services, C.B. The changes proposed by the CONTRACTOR will have to be provided with the express approval in writing of Space WWW Services, C.B. to have validity.

13. PARTIAL NULLITY.

If any part of this contract was opposite to right and, therefore, disabled person, it will not affect at other disposals similar to right.

14. EXTINCTION OF THE CONTRACT.

The present contract will be able to be extinguished by the unilateral denunciation of any of the parts, with a written and reliable notice of 30 days.

The exercise of this faculty will give place not even right to none of the parts to demand indemnification for dammages, exception done to inferred fraudulent or culposamente and of the derivatives in favor of Space WWW Services C.B., if as a result of the early extinction, hanging quantities corresponding to services were remaining dependent on fertilizer given previously.

Nevertheless the previous thing, and in accordance with the general norms of hiring, the nonperformance for any of the parts of the carried away obligations legal or contractualmente, will authorize to another part to consider it to be decisive automatically and of right plenary meeting without need for notice, being enough with the reliable notification of this resolution to the unreliable part, indicating the will and the cause of extinction.

15. JURISDICTION.

The present contract will be ruled in all the aspects by the Laws of Spain and any conflict that arises by virtue of this contract or as regards the same one, it will be subject to the exclusive jurisdiction of the courts of Madrid, to those that both parts submit with resignation to his own jurisdiction, if they had it, with the exception of which the Company Space WWW Services C.B., it will have right, according to his exclusive will, to urge procedure in the courts of any other country in which the CONTRACTOR resides or in that any of the assets are placed of the CONTRACTOR and/or companies of his group.

16. TYPES OF PLANS.
